			<content:encoded><![CDATA[<p>Achei uma boa idéia responder a algumas perguntas que nos são feitas com frequência  nas clinicas que Ana Lucía e eu temos oferecido em Everett, Allston, East Boston, Rockland, Lynn, Lowell e outras paróquias onde estão nossas  comunidades brasileiras.Pergunta : Eu entrei pelo México faz três anos, mas nunca tive problemas com imigração.  Conheci um (a) americano (a) e queremos nos casar.  Tem como eu entrar num processo de legalização?</p>
<p>Resposta: Geralmente quando alguém entra nos Estados Unidos sem visto, não pode ganhar estatus legal dentro do país.  Existem excessões, como no caso das pessoas que procuram asilo ou pessoas que tem o beneficio de uma legalização previa como a 245 I, por exemplo.  Geralmente a  pessoa teria que deixar os Estados Unidos e tentar na embaxada ou no consulado.  Mas para complicar ainda mais as coisas, ha algums anos o congresso aprovou uma lei que diz que toda pessoa que ultrapassa a sua permanência por mais de um ano ou que está aqui sem estatus por mais de um ano, no caso de sair dos Estados Unidos,  não poderã  voltar por dez anos.  Se a pessoa ficou aqui sem estatus legal por 180 dias, a proibição de voltar será por três anos.  Por esta razão, quando a pessoa voltar para o seu país para tentar ganhar a residência teria que pedir um perdão das autoridades, o qual pode ser muito dificil.</p>
<p>Pergunta: Então, como é que eu faço para conseguir esse perdão?</p>
<p>Resposta: Para conseguir esse perdão, a pessoa deve  mostrar as dificuldades que representaria para o conjuge americano que a pessoa extranjeira não pudesse voltar aos Estados Unidos ou que o conjuge americano tivesse que morar fora do país.  Dificuldades para o extranjeiro não interessam ao consulado.  Como nós dizemos, em quanto pior for a situação, mais forte o caso.  Geralmente, se o cidadão (ã) americano (a) tem dificuldades extremas do tipo médico ou psiquiatrico e tem documentos que o provam, isto aumenta as possibilidade de ganhar este perdão.  Cada caso é estudado individualmente, por isso é importante olhar cada caso em particular com muita atenção.</p>
<p>Pergunta: Entrei pelo México a uns dois anos atrás e fui pego (a) pela imigração, mas eu não usei meu nome verdadeiro.  Tem como me legalizar se abrir uma nova lei?</p>
<p>Resposta: É provavel que as autoridades migratórias tenham tirado as impressões digitais da pessoa que foi pega.  Toda vez que alguém pede algum beneficio de imigração como residência ou cidadania, as autoridades exigem tirar novamente as impressões digitais.  Isto revela a identidade da pessoa.  Por isso, teríamos que ter uma reforma muito ampla na lei para beneficiar uma pessoa nestas circunstâncias.</p>
<p>Pergunta: Vim com visto de turista faz  três anos.  Meu noivo (a) é americano (a).  Quando nós casarmos ele(a)  pode  pedir a residência pra mim?</p>
<p>Resposta: Pelo menos é possível (espero que não tenha imaginado que um advogado iria dar um sim absoluto) Eu teria outras perguntas para fazer, mas posso dizer que tenho visto vãrios casos &#8220;simples&#8221; nos quais a pessoa ganhou a sua residência.</p>
<p>Pergunta: Vim aos Estados Unidos com passaporte italiano, (ou de outro país europeu) onde não precisava de visto e podia ficar por noventa dias, só que ultrapassei minha permanência.  Posso ganhar minha residência através de casamento com cidadão (ã) americano (a)?</p>
<p>Resposta: Esta é outra possibilidade.  Como na pergunta anterior, eu faria algumas perguntas para ter uma idéia mais clara do caso (veja a próxima pergunta).  A grande desvantagem do &#8220;visa waiver&#8221; é que, se  a pessoa for pega pela imigração, não teria direito a audiência em corte nem a fiança.</p>
<p>Pergunta:  Quais são algumas coisas que podem complicar um caso em que a pessoa entrou com visto ou com passaporte europeu?</p>
<p>Resposta: Uma pequena lista:  fraude migratária, envolvimento criminal, arrestos, ordens de deportação no passado e falsa declaração de cidadania americana.  Existem formas de perdão para algums destes problemas.</p>

			<content:encoded><![CDATA[<p>Last night, I went to an excellent presentation sponsored by the Boston Bar Association  at the John Adams Courthouse. Immigration Judges Leonard Shapiro and Matthew D&#8217;Angelo and Court Administrator Bob Halpin put in a solid two hours of advice on how to present cases.</p>
<p>The commentary ranged from what should have been obvious (don&#8217;t take out your frustrations on the clerks &#8212; who doesn&#8217;t know that this is the legal equivalent of slitting your own throat?)  to more esoteric issues surrounding the new Immigration Court Practice Manual that will go into effect on July 1, 2008.</p>
<p>This sort of event is a great benefit to members of the immigration bar; the judges spoke to a packed room, and the attendees I spoke with afterwards all agreed that it was a fantastic presentation. My thanks to the Court and the BBA for an informative evening!</p>
<p>CORRECTION: the presentation was solely sponsored by the BBA, not jointly with AILA, as I previously mentioned.</p>
